Content of the Land Registration

The land registration contains the data of all landed and other properties countrywide by settlements, the related rights and the legally significant facts, also the identification data needed for the registration of those persons recorded therein.

Elements of land registration:

Property sheet and its parts

Land offices maintain the data of all landed or other properties, the related rights and legally significant facts on computerized property sheets. Identification goes by settlements, and within those by location, using the parcel identification numbers. Every land parcel or other real estate has its own separate property sheet. The property sheets are marked by serial numbers. The property sheet consists of three parts marked by Roman numbers (Parts I, II and III).

Content of Part I (descriptive data of the land/property):

  • Name of the settlement, address of the land/property
  • Parcel identification number, location (built-up area, rural area)
  • Size of the land/property (m2)
  • Cultivation line (arable land, grassland, meadow, vineyard, garden, orchard, reeds, forest, afforested area, fish pond), or area removed from cultivation (e.g. road, ditch, unbuilt area, or denomination of the main destination of the building: residential house, farm house etc.)
  • Classification of lands under agriculture or silviculture, size and the corresponding cadastral net income (Gold Crown value)
  • Legal status of the land/property (protected area, mine property, monument, condominium etc.)
  • Real servitude and land use right.

Content of Part II (ownership information):

  • Ownership rights (data of the owner, ownership proportion, facts on the owner’s status e.g. under-age  or minority declared by the court) 
  • In the case of State-owned property the name of the organization exercising the owner’s rights
  • Right of property management of a trustee.

Content of Part III (other rights in land/property and the persons entitled to those):

  • Land use right, usufruct and right of using
  • Right of using to place surveying marks and electric equipments there
  • Easements for water conducts, mining and pipelines
  • Rights of pre-emption, repurchase and purchase
  • Right of allowance and life annuity· Right of mortgage and distraint.   

Further on,  facts connected to the registered rights and the persons entitled, like:

  • Facts on the under-age or minority status of the entitled person registered in Part II,
  • Proceeding of distraint or final settlement started against the entitled person
  • Limitation in property, based on judgement· Prohibition of building or plot forming, limitation of building activity
  • Starting a proceeding of expropriation or plot forming· Fact on rejecting the application for registration
  • Prohibition of sale and encumbrances/charges
  • Keeping the place in rank    
  • Fact of suspending the land registration procedure· Permanent damage to the environment
  • Fact of establishing or destroying a building.

The Archives

The Archives keep the documents, their authenticated copies – submitted by the client or his/her representative – serving as a basis of registration and also all documents created in relation with the given case.

The cadastral map

The cadastral map is a copy of the national geodetic base map. It is designed to show the geographical location of the lands and other real estates in accordance with the land registration data. The cadastral maps of built-up areas are produced at the scale of 1:1000, rural areas of 1:4000. The scale of the floor plan of other real estates (e. g. a flat in a condominium) is at least 1:100. If the base map is available as a computerised dataset (digital base map), this one is to be considered as cadastral map. 

Any changes made in real restates (e. g. subdivision of the plot) are indicated on the cadastral map. The content of the cadastral map produced on map sheets divided by settlements is the following:

  • Settlement name, map sheet number,
  • Borderline of the settlement, location and borders of the land parcel
  • Parcel identification number
  • Building, other construction
  • Sub-parcel, cultivation line, quality classification, sample area
  • Street name, house number

Those changes influencing the content of both the cadastral map and the property sheet should only be recorded parallel, corresponding to each other.
