The Act CXLI/1997 on Land Registration provides accession to TakarNet System for certain users and user groups and regulates the access conditions. Further conditions of making use of electronic land office services and details of data servicing are regulated by the decree 176/2009 (XII.28) FVM (Ministry of Agriculture and Rural Development). Prices and fees of data servicing and the other relevant instructions are determined by the Act LXXXV/1996. The order of the accession to TakarNet land office computerized system is the following: 1. Applying for the Access Permit 2. After having the Access Permit, making the Service Contract Further information The user – referring to acceptable reasons – submits a written Application for Access Permit (only in Hungarian)to the Ministry of Rural Development, Department of Land Administration and Geoinformation (MRD DLAG). The application can be submitted on the standardized form issued for this purpose as the enclosure to the ministerial decree clause (No. 109/1999 (XII.29.) FVM) of the Act on Land Registration. The Application for Access Permit can be submitted only in Hungarian on the standardized form issued for this purpose that can be downloaded here in Acrobat pdf format. It can be found under the menu Forms, where one can fill it in online. TAKARNET application form for instituions and companies TAKARNET application form for lawyers, notaries and bailiffs The correctly filled application forms are to be submitted in two copies with original signature to the Ministry of Rural Development, Department of Land Administration and Geoinformation (1055 Budapest, Kossuth tér 11., 1860 Budapest 55 Pf. 1.) When submitting the application – in line with the Act XCIII/1990, § 29. par. (1) – general procedural duties are to be paid. This duty is payable in duty stamps of HUF 2200, sticking them on one copy of the application. Those applicants exempted of the payment should submit a declaration stating that after their entrepreneurial activity or performance, in the year preceding the submission of the application they were not obliged to pay into the central budget. The application will be judged in the Ministry; the applicant will be notified about the result in a written decision. ENCLOSURES TO BE SUBMITTED TOGETHER WITH THE APPLICATION: Lawyers, public notaries, individual bailiffs of the court should enclose the certificate of the competent Chamber (issued not earlier than 30 days) saying that the applicant’s membership is existing, he/she did not suspend the activity and there is no disciplinary action opened against him/her. Institutions financed from the national budget (e. g. local governments) – if they wish to be exempted of paying data supplying fee – should submit a declaration stating that after their entrepreneurial activity or performance, in the year preceding the submission of the application they were not obliged to pay into the central budget. Other companies should enclose the current, original, authentic (or by public notary authenticated) certificate of registration (issued not earlier than 30 days) and the original, authentic specimen of signature. Private individual entrepreneurs should enclose to the application form for natural persons, filled in two copies an official original certificate issued by the competent document office not earlier than 30 days saying that the applicant has been and is also currently registered as private entrepreneur. The certificate should mark the field of activity of the applicant, verifying the necessity of the online query of land office data. Back Based on the Access Permit issued by the Ministry, the Institute of Geodesy, Cartography and Remote Sensing (FÖMI) will prepare the Service Contract specifying the use of TakarNet system and sends it by mail to the User. The Contract is made between the User possessing the Access Permit and the operator of the system, FÖMI, assigned by the Department of Land Administration and Geoinformation of the Ministry of Rural Development (MRD DLAG). The Individual Service Contract in threecopies will be posted for signing to the User by FÖMI (1049 Budapest, Bosnyák tér 5.) The General Service Conditions and enclosures (containing details on the technical features of the service, its conditions, the availability of the system etc.) will also be posted together with the Individual Service Contract. The service contract and its enclosures specify the services accessible for the User, the number of the access, payment obligations etc. The institutions and companies should declare in the contract, how many digital certificates they need, and for how long period of time of validity.
When determining the number of the digital certificates, please consider that with one certificate you can have at one time only one access, and that you can select and pay two different periods of time for your certificates. (See the Fees here) All three copies of the Service Contract signed by the User are to be returned to FÖMI. The original specimen of signature should be enclosed. After the arrival at FÖMI of the contract signed by the User, an invoice will be posted to him/her, showing the costs of producing the digital certificate and its maintenance. After the payment arrives to FÖMI, the service contract will be signed by the General Director of FÖMI. After having the signature of the General Director on the Service Contract, the Client will be registered as User. At a mutually agreed date and time, FÖMI issues the digital certificate under the number figuring in the contract, the client copy of the contract and gives detailed information about the technical conditions of the accession to TakarNet, its implementation and the use of the system.
