3D Cadastre in Norway

A pending proposal for a new Law on the Cadastre in Norway includes for the first time regulations for establishing and registering properties under and above the surface. The new regulations shall typically cover for registration of parking garages in the underground, or for registration of building/constructions on pillars above the surface, as separate properties. It is assumed that the law will be adopted by the Parliament in 2002.
The proposed regulations consider 3 D properties to be subdivided and registered largely in line with establishing parcels on the surface. The Law Committee saw no major problems in making neighbouring properties vertically "above each other", than dividing properties horizontally, making neighbours "next to each other". The proposal refers to 3 D properties as "Construction properties", proposing that such properties should only be registered when it is needed for realisation of a specific construction. An important issue is to ensure a distinction between ”construction properties” and condominiums.

The future: unified land registry!

We wish to line up arguments against those statements on the separation of the unified institutional system of land registration, disputing its organizational status and connecting the questions with the concept of the new Civil Code.  Our effort is based on our dedication to profession, the deep knowledge of the duties, state-of-art and accidental smaller operational insufficiencies of the land management sector, and also on the civilian intention aiming at optimal using of the tax paid by the citizens and avoiding any wasteful investments.

Do we need to make society more aware of the benefits of the land administration system?

We are all convinced that a functioning land administration system is an essential part of the legal and institutional framework of all European countries. The European Human Rights Convention prescribes its establishment and maintenance. Economic activities, investments into real property, housing development, agriculture, land use planning, build-out of infrastructure and urban development require an effective land administration system.

I recognize that in some countries the Government is reluctant for various reasons (politics, incompetence, lack of funds) to set priorities for the improvement and further modernization of the land administration. („If it is not broken, do not fix it.”)
